Commissioner of Oaths

Book an appointment

Appointments with the Commissioner of Oaths are available weekly on Tuesdays, Wednesdays, and Thursdays.  All appointments are in person only at City Hall, 1 Carden Street, Guelph.

Prepare for your appointment

  • Person(s) signing the document must be present at the appointment and show current, government-issued photo identification that matches their name on the document being commissioned
  • Documents must be filled out prior to the appointment and be unsigned
  • The Commissioner of Oaths has the sole discretion to commission a document or not

Fees

  • The fee for the City’s Commissioner of Oaths service is $39.55. (A different fee may apply depending on the quantity or type of documents being commissioned.)

What is a Commissioner of Oaths?

The City’s Commissioner of Oaths is a person designated to take oaths or declarations when you sign an affidavit or statutory declaration on a document. The City of Guelph does not have a Notary Public. A Commissioner of Oaths reserves the right to decline service where identification, document validity, legal scope, or other required conditions are not met. Examples of documents the Commissioner of Oaths may sign are listed below.

Commissioning Service Tiers

To help clarify what services are available, commissioning requests are now categorized into three tiers:  

Tier 1 – Common Services

Available by walkin or by appointment, subject to availability. 

Please refer to the list of common services below.

  • Sworn statement for family gift of a used motor vehicle 
  • Application to change a name 
  • Declaration for a change of sex designation 
  • Declaration of common law or single status 
  • Statement of conscience or religious belief 
  • Consent to travel with child (travel letter) 
  • Application for authorization and statutory declaration for the purposes of entry into Canada 
  • Construction completion form 
  • Affidavit of live birth 

Tier 2 – Case‑by‑Case Services 

Available by appointment only

Please refer to the case-by-case services below. 

  • Foreign pension document (or proof of life) 
  • Statutory declaration of lost identification 
  • Declaration of unregistered vehicle 
  • Declaration of a true copy (we do not commission certified true copies) 
  • Court affidavits 
  • Ontario Land Transfer Tax Refund Affidavit 
  • Statutory Declaration in Lieu of a Guarantor 
  • Documents that contain exhibits 
  • Miscellaneous affidavits (for example: never married, fraud, proof of payment, indemnity, ADU grant program) 

Tier 3 – Documents We Are Unable to Commission

These documents cannot be commissioned by the City’s Commissioner of Oaths.

  • Wills, living wills, codicils, or estate settlement documents 
  • Powers of attorney 
  • Divorce, separation, marriage agreements, or custody documents 
  • Real estate matters (sale, purchase, or mortgages) 
  • Debt-related documents 
  • Documents not in English or without English descriptors 
  • Certified true copies 
  • Documents requiring the signature of a Notary Public
